My fee is determined based upon the facts and circumstances of each case. The objective in determining the fee is always what is fair and reasonable to deliver the services required to represent the Personal Representative to a successful conclusion of probate considering the specific factors of the estate and with an overriding goal to deliver value for the fee earned compared to billing by the hour or by some factor tied to estate value.
All estates, regardless of size, have certain “legalities” required for ordinary post death “settlement” services in probate. It is the differences amongst estates that are not necessarily related to size, that factor into the work that will be required and thus the fee that will deliver value to the estate and its beneficiaries for accomplishing the work required by the law. To be fair in delivery of value, estate size does not determine my fee.
A brief comparative example may help you understand my approach. The examples assume the estates are given outright to children and no estate tax applies after considering lifetime giving, if any, of the parent.
Case 1.
An estate with a total value of $1mil. having some personal property including a car with no loan outstanding, a savings and checking account at one bank, and a brokerage account as well as a final electric bill, phone bill and water bill.
Case 2.
An estate with a total value of $750,000 having some personal property including a car with a loan outstanding, a savings account in 3 different banks, a checking account in another, a brokerage account, paper stock certificates as to 5 companies, a final electric bill, phone bill, water bill, and several credit cards with small balances.
The estate in Case 2 has more work to perform and responsibility to bear than the estate in Case 1. Since 1) the Personal Representative is legally responsible to both beneficiaries and creditors, and 2) there is a greater number of assets, creditors and affiliated “institutions” to address in Case 2 than in Case 1, the attorney’s fee will be greater for Case 2 than for Case 1 despite that Case 1 is a “larger” estate by value.
